CEL Seminar - Fiat and Starbucks:The first two tax ruling judgments

This seminar will examine the specific legal questions arising from the recent (24 September 2019) EU General court ruling that Starbucks do not have to pay up to 30 million euro in Dutch back taxes whilst Fiat lost its challenge to pay a similar amount as the Court agreed with the Commission’s original decision. These cases were part of a crackdown by the Competition Commissioner, formerly Joaquin Almunia and currently Margrethe Vestager on unlawful tax breaks by EU countries to multinationals which could potentially be in violation of State Aid Rules. In the case of Starbucks no special tax treatment was found but in the case of Fiat Chrysler Finance Europe, who had priced their services below market rates therefore affecting profits and subsequent tax liability the decision was upheld.
Both these rulings may have implications for the Apple case whereby they were accused of having unlawfully avoided paying of taxes which is currently under appeal by the company and the Irish government’
